Shipping and Delivery Terms and Conditions.

 General Shipping Information:

Africa Harvest Exporters facilitates the export of fresh agricultural products via air, land, and sea, under internationally recognized Incoterms (FCA, FAS, FOB, CPT, CIP, CFR, CIF).

All shipping arrangements are subject to product availability and confirmation of payment.

Estimated shipment dates are provided as a guide and are not guaranteed. Delays may occur due to factors beyond our control, including but not limited to customs clearance, carrier delays, and unforeseen logistical issues.

We reserve the right to modify or discontinue any shipping option at any time. Shipping methods are selected based on product perishability and order urgency. Air freight is used for highly perishable goods and urgent orders, while sea freight is used for larger, less perishable orders. Land freight is used where applicable.

Incoterms and Responsibilities:

We operate under the following Incoterms:

FCA (Free Carrier), where we deliver goods to your nominated carrier at a specified location, and you assume responsibility for all subsequent costs and risks;

FAS (Free Alongside Ship), meaning we place the goods alongside your vessel at the named port of shipment, and risk passes to you at that point;

FOB (Free On Board), where we load goods onto your nominated vessel at the port of shipment, and you assume responsibility for risks and costs after loading;

CPT (Carriage Paid To), where we pay for freight to the destination, but you assume risk when goods are handed to the carrier;

CIP (Carriage and Insurance Paid To), similar to CPT but we also pay for minimum insurance coverage to the destination;

CFR (Cost and Freight), where we pay for freight to the destination port, and you assume responsibility for risks and costs after loading;

CIF (Cost, Insurance and Freight), which is like CFR but includes our obligation to obtain minimum insurance coverage during the sea voyage.

Under these Incoterms, you are responsible for: Import duties, taxes, and customs clearance in your country; obtaining necessary import permits and licenses; arranging and paying for insurance (if desired, except under CIP and CIF); all costs associated after the goods have been delivered to the agreed Incoterm location; and maintaining the cold chain and proper storage conditions after the goods have been transferred to your responsibility.

 Shipping Costs and Payment:

  Shipping costs are calculated based on the selected Incoterm, destination, shipping method (air, land, or sea), weight, and volume of the shipment. Payment for goods and shipping must be received in full before shipment is arranged. Any additional charges incurred during shipping, such as storage fees or demurrage, are the responsibility of the buyer.  

 Customs and Documentation:

  We will provide necessary export documentation as required by our country's regulations, including phytosanitary certificates where applicable. You are responsible for providing any required import documentation for your country and adhering to your country's import regulations. Delays caused by customs clearance are beyond our control. The buyer bears the risk of spoilage due to such delays. We will not be held responsible for any losses incurred due to incorrect or incomplete documentation provided by the buyer.  

 Inspection and Acceptance:

  Due to the perishable nature of our products, you are responsible for inspecting the goods upon arrival at the agreed Incoterm location within 24 hours. Any claims for damage, spoilage, or discrepancies must be reported in writing with photographic evidence within 24 hours of receipt. Failure to report within the specified timeframe constitutes acceptance of the goods. Inspection should include checking for signs of temperature damage, pest infestation, and general spoilage.  

Packaging:

  We use industry-standard packaging designed to maintain the freshness and quality of our produce during transport.  

Temperature Control:

  We follow strict temperature control procedures during the export process to ensure the freshness of our produce.  

 Limitation of Liability:

  Our liability for any loss or damage is limited to the value of the goods as stated in the invoice. We are not liable for any indirect, consequential, or incidental damages. We are not responsible for delays caused by third-party shipping companies, customs delays, or any other cause outside of our direct control.  

Force Majeure:

  We are not liable for any delays or failures in shipping caused by events beyond our reasonable control, including but not limited to natural disasters, acts of war, strikes, or government regulations.  

Governing Law and Jurisdiction:

  These terms and conditions are governed by the laws of South Africa. Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of South Africa.  

Amendments:

  We reserve the right to amend these terms and conditions at any time without prior notice.
